I am a paralegal with an associates degree. I also have some experience, but not a lot. I worked as a legal secretary and did some bankruptcy work but no petition preparation, motion drafting, etc. I even made sure to get familiar with the software. Now I work at a non profit and I am still doing some bankruptcy work but I am not doing the cases. I took the class in school and I even filed a case pro se. What more could I do to compel an attorney to hire me? I always excel at my jobs and I know that I can do it. I just don’t know how to get in.

(1) We are in a RECESSION. There are no jobs. You aren’t going to “get in”. There are no jobs.
(2) Employers (usually law firms) want employees with Bachelors degrees. Anything less is worthless. The field of Law is VERY, VERY competitive. And now that we are in a Recession, it is fierce – there is backstabbing everywhere.
(3) Jobs in the field of Law are drying up fast. This was not a good field to invest in. We simply have WAY TOO MANY Legal Professionals – we have a GLUT! (“Legal Professionals” includes, but is not limited to: Attorneys/Lawyers, Paralegals, Legal Assistants, Legal Secretaries, Bailiffs, Court Reporters, etc, etc.)
The law schools know this – they know the economy/market is SATURATED – yet they continue to recruit and churn out graduates. A law student is easy money for a law school – a law school has to make very little investment in a law student.

what do you mean by “creation”
do you mean simply entering information on the forms (with information provided SOLELY by the client) or do you mean developing documents for an attorney to use in their practice?
in most states you can NOT represent a client in ANY way in ANY legal matter or offer ANY legal advise unless you are licensed to do so……….
in MOST if not ALL states a paralegal, with or without, a diploma/certificate/accredidation is NOT licensed to practice law……..

I have years of experience working in a Law Firm and I know how to prepare a Bankruptcy Chp 7 and Chp 13… do I need to be accredited and have a certificate and/or degree if I choose to run my own business alone?

you can NOT offer ANY legal advise of any kind or represent a client in ANY manner with or without a paralegal certificate……
anyone can do the actual physical part of filling out any form, but you can NOT do anything more then actually type (or write) the information on the paper……..
if you charge for the service you provide, and just make a ” hypothetical suggestion” you are in violation of the law and may be prosecuted…… practicing law without a license is a criminal offense.

Due to a failed business and mounting debt, my wife and I just filed for bankruptcy. After considering many career choices in a bad economy, I have decided to pursue a paralegal certificate at a local community college. I already have a master’s degree but my fear is that I won’t be able to find a paralegal job because of the bankruptcy. Any advice?

If you own a degree – or any other qualification – then you’ll already be in front of of the bunch when it comes to searching for careers. My pal has a degree and he wasn’t certain what direction to go with it, but he found some good tips and tricks on the site in the resource box below which aided him to decide that he wanted to be a lab assistant. There is lots of guidance on the site regarding other careers.

We are in a bind and only getting in deeper, so we have to file bankruptcy. We have a home and two vehicles we want to try and keep. Is a paralegal service that says they specialize in Bankruptcy just as compident as a lawyer? The fee’s a lawyer wants to charge me is so steep I cant even pay her. And we are being sued so we have to get this done. Any suggestions or opinions?

I dnt owe any property, I rent with my family. Have a old 85 Toyota car. Has there been sucssesful bankruptcy cases handled by paralegals?

A co-worker of mine referred me to a paralegal that has helped a few of her friends and cousins get through bankruptcy. He is only going to charge me $ 600 (as opposed to up to $ 1700 with a lawer) and literally walk me through it. I guess the word “paralegal” is worrying me a little because he is not a lawyer but does anyone else have any experience with a paralegal and bankruptcy?

No, a paralegal can just give you advice, but if you have the time you can do the research yourself and save the $ 600.

I am a certified bankruptcy paralegal who has 10 years + experience. I want to open my own firm from home but know there are other forms I have to file with the petitions and are not sure where to find the information on line or in books. I am also not sure where I am suppose to sign as a document preparation when I file and would appreciate anyone’s help with links to paralegal help and books.

There are provisions for petition preparers (typists) being allowed to charge fees. I believe that the Court rules or Federal rules prohibit you from referring to your assistance as a paralegal service, since if you are doing anything other than typing the forms from instructions supplied by the debtors, you’ll be practicing law.
