My husband and I are about to sign our bankruptcy paperwork and the paralegal at the attorney’s office advised us to take 99% of the money in our bank accounts out immediately. My questions are: 1) do we need to keep receipts or do something to show where this cash is being spent since it isn’t in our account; 2) I’m guessing they will need a bank statement showing the account balance – how far back will we need to provide statements for? Thanks!

Just tell them that you paid off family and friends debt from cash you had borrowed to get by

On the first floor of my office building is a law office that’s chock full of small-time lawyers and lowly paralegals. They’re all up to their ears in debt and spend all their disposable income on fancy clothes and luxury vehicles such as BMW or Mercedes. They also apparently feel that they’re so important that they park in the visitors parking spaces every day!

Why do these people insist on taking visitors parking spaces? Are they trying to compensate for something?

be very careful what you say about paralegals. i have a 4 year degree and make darn good money. i personally wouldn’t park in visitors spots though. you sound jealous

I can’t recommend any bankruptcy attorneys in LA, it’s not my area, but I think you better look into student loans and bankruptcy before paying an attorney.

Discharge due to bankruptcy is only under rare circumstances. Maybe if one was paralyzed in a coma and had 4 minor children to support on their disability check. Seriously. That’s what the judges consider undue hardship. It’s been this way since changes were made in 1998 and 2005. You may be able to consolidate under Chapter 13 if you have enough income and not very much debt. But it won’t eliminate it and you must continue to pay any student loan balance even after you complete your plan.

Usually attorneys want to use translators who are experienced with legal work, but I have heard of instances where they will let a client pay off with translations. (But honestly, I think he just wanted to date the client. ugh)

what do you mean by “creation”
do you mean simply entering information on the forms (with information provided SOLELY by the client) or do you mean developing documents for an attorney to use in their practice?

in most states you can NOT represent a client in ANY way in ANY legal matter or offer ANY legal advise unless you are licensed to do so……….

in MOST if not ALL states a paralegal, with or without, a diploma/certificate/accredidation is NOT licensed to practice law……..

I have years of experience working in a Law Firm and I know how to prepare a Bankruptcy Chp 7 and Chp 13… do I need to be accredited and have a certificate and/or degree if I choose to run my own business alone?
(need “a” paralegal certificate)

you can NOT offer ANY legal advise of any kind or represent a client in ANY manner with or without a paralegal certificate……

anyone can do the actual physical part of filling out any form, but you can NOT do anything more then actually type (or write) the information on the paper……..

if you charge for the service you provide, and just make a ” hypothetical suggestion” you are in violation of the law and may be prosecuted…… practicing law without a license is a criminal offense.
